CONCERNING
THE AFFIRMATION OF DUTIES AND RESPONSIBILITY OF THE MINISTER OF TRADE IN THE FOREIGN TRADE AFFAIRS

WE, THE PRESIDENT OF THE REPUBLIC OF INDONESIA OFFICERS,

Considering:

That in order to achieve efficiency and effectiveness in the administration of foreign trade (exports and imports) to assure the success of the economic stabilization and rehabilitation plan is necessary to reinforce the duties and authority of the Minister of Trade in the field of foreign trade.

In the view of:

1. The 1945 Constitution, article 4 paragraph (1);

2. MPRS Decree No. XXIII/MPRS/1966;

3. MPRS Decree No. XXXIII/MPRS/1967;

4. Law No. 32 of 1964;

5. Government Regulation No. 10 of 1967;

6. Presidential Decree R.I. No. 177 of 1966;

7. Presidential Decree R.I. No. 171 in 1967;

8. Decree of the Presidium of the Cabinet R.I. No. 66/EK/KEP/10/1966;

9. Decree of the Presidium of the Cabinet R.I. No. 170/EK/KEP/7/1967.

DECIDED:

to stipulate:

Presidential Decree of the Republic of Indonesia concerning the affirmation of duties and responsibility of the minister of trade in the foreign trade affairs.

Article 1

(1) The Minister of Trade established a policy of foreign trade (exports and imports) and organize and supervise the implementation based on the general policy of the Government that has been established, and considering the authority, duties and responsibilities of the Ministry/Department and other agencies based on laws and regulations.

(2) The Minister of Trade duties and responsibilities in the foreign trade affairs (exports and imports), will be further regulated in the Articles 2 and 3 of this Presidential Decree.

Article 2

The definition of the duties and authority of the Minister of Trade in the field of export are:

(1) Prepare an export target for each year that includes all kinds of goods produced in Indonesia which can be exported from Indonesia as well as making foreign exchange earnings estimation on the sale of goods based on the export target.

(2) Stipulate and launch active and effective marketing policy to improve the position and role of Indonesia as International market producer.

(3) Conduct empowering efforts in the field of marketing and development to achieve and to increase the volume and the value of export plan.

(4) Set restrictions on the export of goods produced by Indonesia, which is required under international agreements or by considerations of national interest.

(5) Develop and guide the export trade officers from the State and the private sector towards a positive function in an effort to assist the success of the Government's program.

Article 3

The definition of the duties and authority of the Minister of Trade in the field of import are:

(1) Establish a list of items which can be imported into Indonesia.

(2) Develop and guide the import trade officers from the State and the private sector towards a positive function in an effort to assist the success of the Government's program.

Article 4

This Presidential Decree shall come into force on the date of the stipulation
